Terms of service
Who these terms are between
These terms are between Honbu (operated by Richard Benson) (the operator) and anybody who uses Honbu: an organisation that keeps its register here, and the people who sign in through it. By signing in or creating an account you agree to them. If you are under 18, a parent or guardian agrees for you.
The service
The service helps an organisation run its register, classes, gradings, events, payments and communications. The organisation chooses how to use it, and is responsible for the accuracy of what it enters and for telling its members how their information is used.
Accounts
- Sign in with the email address given to your club. Keep your mailbox safe, because a sign-in link opens your account.
- Do not share a sign-in link or let another person use your account.
- An organisation decides who on its team can do what, and is responsible for removing people who no longer need access.
What you may not do
- Break the law, or use the service to harass, threaten or harm anybody.
- Upload something you have no right to share, or anything unlawful or harmful, in particular anything that puts a child at risk.
- Try to get into information that is not yours, test the security without our written agreement, or disturb the service.
- Use the service to send unwanted marketing.
Your information
The organisation owns its information, and the operator holds it for the organisation. The operator uses it only to run the service, and never sells it. An organisation can download its data at any time.
Where the law counts the operator as handling information for an organisation, the organisation and operator will sign a data processing agreement on request.
Payments
Fees between a member and a club are between them. Card payments are taken by the payment provider, and its terms also apply. Fees for the service, if any, are agreed with the organisation in writing, and a change takes effect after reasonable notice.
When things go wrong
- The service is provided with reasonable care and skill, and we aim to keep it running, but it may sometimes be unavailable.
- To the fullest extent the law allows, the operator is not liable for indirect or consequential loss, or for loss caused by something outside its control. Nothing in these terms limits a right you have under the Consumer Guarantees Act 1993 or other law that cannot be limited, and no limit applies where the law says it cannot.
Ending
You can stop using the service at any time, and an organisation can close its account. We may suspend or close an account that breaks these terms or puts others at risk. After an account closes, the organisation can download its data for ninety days, and after that it is deleted, apart from what the law requires to be kept.
Changes
When these terms change in a way that matters, we will tell the organisation before it takes effect. Carrying on using the service after that means you accept the change.
Law and disputes
These terms are governed by the law of New Zealand and the courts of New Zealand, though that does not remove any protection that the law where you live gives you and that cannot be set aside. Please tell us about a problem first, so that we can try to put it right.
